Roman Law and Economics

Autor: Giuseppe Dari-mattiacci , Dennis P. Kehoe

Número de Páginas: 458

Ancient Rome is the only society in the history of the western world whose legal profession evolved autonomously, distinct and separate from institutions of political and religious power. Roman legal thought has left behind an enduring legacy and exerted enormous influence on the shaping of modern legal frameworks and systems, but its own genesis and context pose their own explanatory problems. The economic analysis of Roman law has enormous untapped potential in this regard: by exploring the intersecting perspectives of legal history, economic history, and the economic analysis of law, the two volumes of Roman Law and Economics are able to offer a uniquely interdisciplinary examination of the origins of Roman legal institutions, their functions, and their evolution over a period of more than 1000 years, in response to changes in the underlying economic activities that those institutions regulated. Volume II covers the concepts of exchange, ownership, and disputes, analysing the detailed workings of credit, property, and slavery, among others, while Volume I explores Roman legal institutions and organizations in detail, from the constitution of the Republic to the management of...

European Competition Law Annual 2004

Autor: Claus-dieter Ehlermann , Isabela Atanasiu

Número de Páginas: 646

The European Competition Law Annual 2004 is ninth in a series of volumes following the annual workshops on EU Competition Law and Policy held at the Robert Schuman Centre of the European University Institute in Florence. The volume reproduces the materials of the roundtable debate that took place at the ninth edition of the workshop (11-12 June 2004), which examined the relationship between competition law and the regulation of (liberal) professions. The (liberal) professions and the rules governing their functioning have become of interest for EC competition law enforcement since the early nineties, making the object of a series of Commission decisions and judgments of the European courts. The subject has gained in importance in the perspective of the recent decentralisation of EC antitrust enforcement. The regulation of (liberal) professions is also a matter of increasing concern from the perspective of freedom of services in the internal market. The workshop participants - a group of senior representatives of the Commission and the national competition authorities of some Member States, reknown international academics and legal practitioners - discussed the economic, legal and...

Methods of Comparative Law

Autor: P. G. Monateri

Número de Páginas: 339

Comprising an array of distinguished contributors, this pioneering volume of original contributions explores theoretical and empirical issues in comparative law. The innovative, interpretive approach found here combines explorative scholarship and research with thoughtful, qualitative critiques of the field. The book promotes a deeper appreciation of classical theories and offers new ways to re-orient the study of legal transplants and transnational codes. Methods of Comparative Law brings to bear new thinking on topics including: the mutual relationship between space and law; the plot that structures legal narratives, identities and judicial interpretations; a strategic approach to legal decision making; and the inner potentialities of the 'comparative law and economics' approach to the field. Together, the contributors reassess the scientific understanding of comparative methodologies in the field of law in order to provide both critical insights into the traditional literature and an original overview of the most recent and purposive trends. A welcome addition to the lively field of comparative law, Methods of Comparative Law will appeal to students and scholars of law,...

The Impact of eConveyancing on Title Registration

Autor: Gabriel Brennan

Número de Páginas: 331

This work is an assessment of how to manage risk in property transactions in the context of the move from paper-based to electronic conveyancing (eConveyancing). In particular the focus is on risks that impact on title registration, and the security, protection or lack thereof that this registration offers to land owners, third parties and property claimants. The impact is the extent to which a change in the transactional process may unintentionally affect risk (being the consequence of change and the likelihood of that consequence having a negative effect). The risks are identified, analysed and evaluated against the backdrop of title registration and the development of eConveyancing through a comparative analysis of the systems in Ireland and Ontario, while also referencing other developing electronic systems around the globe.

The Elgar Companion to Ronald H. Coase

Autor: Claude Ménard , Elodie Bertrand

Número de Páginas: 381

Ronald H. Coase, one of the most innovative and provocative economists of the twentieth century, has had a lasting influence in economics, law and economics, organization theory, management and political science. In this comprehensive Companion, 31 leading economists, social scientists and legal scholars, including two Nobel Laureates, offer the first global assessment of the initial impact of Coase’s work and the continuing inspiration that researchers and policy makers find in his contributions. The book presents a review of the continuing power of Coase’s work, including the reshaping of public policies with particular respect to public utilities and network industries. Further chapters explore research programmes that he initiated including the concept of transaction costs and the analysis of property rights, especially in terms of the regulation of the communications industry and the creation of markets for the right to pollute. The book clearly demonstrates the originality of Coase’s work and the challenge that it posed to conventional perspectives which has been a hallmark of his research throughout his life, from his initial view on the nature of the firm to his...
